Nominate someone else for a fine
If you've received a fine or overdue notice but weren’t responsible for the offence, you can transfer the fine to the person who was at fault.
How nominating someone else works
You can nominate someone else if you have received a fine or overdue fine notice, but:
- You weren’t driving the vehicle at the time of the offence
- You sold the vehicle before the date of the offence
You are required by law to name the person responsible for the offence if demerit points are applied. Nominating the person responsible means the fine and loss of demerit points will be assigned to them, not you.
For offences such as littering from a vehicle, you should name the person responsible, even if you were the driver at the time.
For camera detected seatbelt offences, the driver must be nominated for both the driver and passenger fines. The driver is responsible for ensuring that any passenger in the vehicle is wearing a seatbelt. You can find more information on camera detected seatbelt offences on the Transport for NSW website.
Information we need about the person responsible
To transfer your fine to someone else, we need to know their:
- Full name
- Address
- Date of birth
- Driver licence number and the state/country it was issued in
- Passport number and country of issue if you're nominating an international driver.

We may also ask for more evidence in writing, in person or in court.
If the person you are nominating elects to go to court, you will be required to complete a statutory declaration (PDF 847.81KB) and have it witnessed by a Justice of the Peace.
If you don’t know who was responsible
As the registered vehicle owner, you’re responsible for any offence incurred in your vehicle until the responsible driver is nominated. If you don’t know who was driving your car at the time of the offence, you can:
- View a camera image of the offence.
Please note that these photographs are designed to capture the number plate of the offending vehicle, not identify the driver. So the driver may not be visible in some images.

If your nomination is successful
A new fine will be sent to the person you named.
If you have already paid the fine before nominating the person responsible, please call us on 1300 138 118 to request a refund.
If you’re responsible for a fine that was issued to someone else
If you were driving someone else’s vehicle and committed an offence which resulted in a fine being issued in their name, you can have it transferred to your name by mailing a signed and witnessed Statutory Declaration form (PDF 708.95KB) to:

Complete and submit this form if you have incorrectly nominated a person and need to supply the correct person's details.

Providing false information
You must make a reasonable effort to identify the person responsible for the offence. Making a false nomination is a serious offence. If you provide false or misleading information you may receive additional fines and restrictions on your driver licence.
If you have been falsely nominated
If you believe you have been falsely nominated for a vehicle offence you will need to provide us with evidence that shows you could not have been responsible.
Fines issued to company vehicles
Companies are required by law to nominate the driver of a company vehicle for camera-detected offences.
Penalties will apply to companies that fail to nominate.
