Record of condition and accounts for an agricultural tenancy
The record of condition of a farm for an agricultural tenancy can cover the land, buildings, improvements, any removable fixtures and certain other items.
If necessary, a record of the condition of of a farm for an agricultural tenancy can be made at:
- the start of the tenancy, or
- reasonable intervals during the tenancy.
The owner and tenant must jointly do this.
What does a record of condition cover?
The record of condition can cover:
- the land and any cultivation of the land
- any buildings, fences, gates, roads, drains or other works or things on the farm
- any improvements
- any removable fixtures.
Accounts for an agricultural tenancy
Tenants and owners have a duty to keep proper accounts regarding the tenancy. Both parties also have the right to inspect each other’s accounts if reasonable notice is given.
