Cancellation fees apply if you cancel our services after the first appointment. The cancellation fee will be the greater of:
- $275, or
- 30% of the fee given to you as quoted.
We will charge you the full amount of any disbursements (any additional costs we have incurred) leading up to the cancellation.
- any cancellation fee will be deducted from the fees paid
- any balance of the fees paid will be refunded to you
- if the cancellation fee exceeds the fees you paid, you will be required to pay the cancellation fee at the time of cancellation.
Other fees
If you appoint us as your executor in your Will, fees will apply to administer your estate. These fees only take effect after you pass away and are generally charged from your estate.

Deceased estate administration fees
Our fees to administer a deceased estate are prescribed and regulated under the NSW Trustee and Guardian Act 2009 and the NSW Trustee and Guardian Regulation 2017. The fees include the costs associated with obtaining a grant of representation and the cost to administer the estate.
Fees are deducted from your estate and based on the value of the assets that are solely owned by you.
No fee (except a minimal charge to ensure a house is registered in the name of the joint tenant/owner) will apply to joint assets, such as bank accounts, or a house.

A one-off executor fee is charged on solely owned estates. It does not cover disbursements (any additional costs associated with legal action) or other fees and charges.

There are no up-front fees. Executor fees are paid from your estate after you pass away.
Trust fees
We provide you with a friendly and comprehensive service to prepare your trust documents.
A trust is created either by a Will, a deed, declaration or court order:
- If NSW Trustee and Guardian administers an estate that includes a continuing trust, the one-off trustee fee is not charged.
- If you are setting up a new trust or transferring a trust to NSW Trustee and Guardian, the one-off trustee fee is charged.
- If legal work is undertaken for you by our legal team or by external legal service providers, these costs will be additional to NSW Trustee and Guardian trust administration fees.

Financial management fees
All fees for financial management customers are exempt from GST. Fee reductions apply for customers with assets $75,000 and under.

Private financial management fees
Legislation permits NSW Trustee and Guardian to charge fees to carry out our financial management services, but private financial managers are not paid for performing their work unless they have a remuneration (payment for work) order from the Supreme Court of NSW
Our fees are payable from the person’s estate.
It is your responsibility as the private financial manager to pay any invoices that are sent to you by NSW Trustee and Guardian.

Additional fees
There may be additional costs required to deliver our services.
These additional costs are not included in our standard service fees. Where applicable, additional costs will be charged on top of the standard service fees.
Additional costs may include:
- Costs we may need to pay to other organisations to deliver our services, this could be costs to get certificates from Births, Deaths and Marriages and costs to inspect and secure properties.
- Costs we may need to pay our internal specialists to deliver our services, this could be for legal advice, if there are overseas assets involved, if the entitlement or will is contested, or if we have to search for missing beneficiaries and/or prepare family trees.
- Out-of-pocket expenses we may need to pay such as postage, phone and photocopying.
If legal work is done for you by external legal service providers, their costs will be additional to our standard service fees.
If legal work is done by our in-house solicitors, their fees are also additional and are set out as follows:

If we undertake property inspections, including securing a property or taking inventory, then a service provider may be engaged to do this work.
The following additional costs outline the cost to the client or estate to have this work completed.
