This is NSW Trustee and Guardian, a government agency working to protect, promote and support the rights, dignity, choices and wishes of the people of NSW.

We provide a range of customer-centred services.

We write Wills and estate planning documents, store those documents in safe storage.

We act as executors and administer deceased estates and trusts, look after the legal and financial affairs of financial management customers, make health and lifestyle decisions for guardianship customers, and provide information and education for the wider community.

Supported by experts in estate planning, legal, taxation and financial planning, specialists in property, estate administration and trusts, professionals in financial management, guardianship and corporate services, and guided by our award-winning Customer Excellence Program, our services help support and protect people at critical moments in their lives.

NSW Trustee and Guardian protects, promotes and supports the rights, dignity, choices and wishes of the people of NSW.

We support the Chief Executive Officer and the Public Guardian to provide services that meet your needs. We help support and protect some of the most vulnerable members of our community.

Our services include Wills and estate planning, deceased estates, financial management and guardianship services.

We write more than 13,000 estate planning documents each year, support over 47,000 customers annually and manage over $6 billion in customer assets.

Our story

Our story began over 100 years ago in 1847, when Samuel Frederick Milford became the first Curator of Intestate Estates. Follow the timeline and learn more about our story.

1847

Samuel Frederick Milford became the first Curator of Intestate Estates and was responsible for administering the estates of people who died without any living relatives.

1913

The Curator of Intestate Estates was replaced by the Public Trustee of NSW. Thomas William Garrett was appointed the first Public Trustee of NSW in 1914.

1915

In response to World War I, the Public Trustee offered a free Will-making service to soldiers. 

1958

The Mental Health Act 1958 was established, and in 1972, the role of Protective Commissioner was formed.

2009

Legislation was passed by NSW Parliament to merge Public Trustee NSW with the Office of the Protective Commissioner and Public Guardian, forming the current NSW Trustee and Guardian.
