Responding to your offer
Find out what you need to know when considering the offer you've received from the Resilient Homes Program, including what to do if you want to accept or reject it.
Your assessment outcome
After your application has been assessed by the NSW Reconstruction Authority (RA), you will be advised about the outcome of your application for the Resilient Homes Program.
You've received your offer
Once the offer is made, you have 90 days to consider your offer. You will have the option to accept or reject the offer. If you require more time to consider your options, you may also request an extension to the 90 days, however there must be extenuating circumstances in order for an extension to be granted. If you do not agree with the offer you received, you may request an internal review or appeal a decision. The internal review / appeal application must be completed and lodged within the 90 days from the date of your offer.
Accepting the offer
- Homeowners must sign and return an accepted signed letter of offer and any other paperwork.
- Acceptance will activate the process of assigning a contract for the applicable stream (i.e., a contract for sale of the property under the Home Buyback stream, or funding for a grant payment under the other stream/s, plus any other documents which are needed). The Funding Agreements/Sale Contract will set out the scope of works (if applicable) and the terms and conditions under which the funding for a grant payment will be provided.
Rejecting the offer
Home Buyback
Homeowners must sign and return a rejected Letter of Offer.
Note: Not returning a letter of offer after 90 days is automatically deemed as a rejected offer as per the provisions outlined in the Letter of Offer.
Resilient Measures
If you do not wish to proceed with Resilient Measures, including Home Raising, Home Rebuild, Home Relocation or Home Retrofit, you do not need to sign and return the Letter of Offer. RA requests you advise the Resilient Homes Program ream of your intent not to proceed.
Note: Not returning a letter of offer after 90 days is automatically deemed as a rejected offer as per the provisions outlined in the Letter of Offer.
Requesting an extension to consider your offer
- Homeowners must provide in writing extenuating circumstances as to why 90 days is not sufficient time to consider their letter of offer.
- Seeking an internal review or appeal is not grounds for an extension.
Requesting an internal review or an appeal
Homeowners who are dissatisfied with a Resilient Homes Program decision may apply for an internal review or lodge an appeal, if they are dissatisfied with the internal review outcome.
This must be done within 90 days of receiving written notice of that decision, or, if a homeowner is submitting an appeal following an internal review, this must be submitted within 30 days of receiving writing notice of the internal review decision.
