- are not covered by the National Workplace Relations System and the Fair Work Act 2009.
- remain within the NSW Industrial Relations System governed by the provisions of the Taxi Industry (Contract Drivers) Contract Determination, 1984
The Taxi Industry (Contract Drivers) Contract Determination, 1984 (PDF 216.28KB):
- provides for permanent and casual engagement
- only applies to the Metropolitan Transport District as prescribed by the Transport Administration Act 1988. See Metropolitan Transport District below for overview of districts and suburbs.
Summary of basic rights and requirements
Permanent bailee:
- Regularly takes a taxi cab on bailment from the same bailor for five shifts per week or at least 220 night shifts per year.
- Entitled to paid annual leave, sick leave and long service leave.
- Termination: one week's notice by either party is required.

- With no entitlement to any paid leave.
- Termination: No notice is required.

Methods of payment
Schedule 1 of the Contract Determination prescribes two methods of payment being:
- Commission and
- Set Pay-in with the method of payment to be determined by the bailee.
