Pursuant to Section 4 of the Apprenticeship and Traineeship Act 2001, the following Guideline is issued in relation to establishing Apprenticeships and Traineeships for members of the Australian Defence Force.
This guideline applies to training arrangements established with the Department of Defence and uniformed members of the Australian Defence Force.
Under the Defence Act 1903 - Section 27, no civil contract of any kind is created with the Crown or the Commonwealth in connection with member's service in the Australian Defence Force. Members of the Australian Defence Force cannot enter into a National Training Contract with the Department of Defence.
The Department of Defence will enter into Training Arrangement Agreements with members of the Australian Defence Force and complete Training Arrangement forms to be lodged with Training Services NSW for approval and registration. The Training Arrangement Agreements will contain the information required under Section 7 of the Apprenticeship and Traineeship Act 2001 to establish apprenticeships and traineeships in NSW.
The Training Arrangement can only be discontinued in accordance with Australian Defence Force Service policy for each qualification and vocation. Any dispute between a member of the Australian Defence Force and the Department of Defence will be resolved in accordance with Australian Defence Force policy, which includes Redress of Grievance and applications to the Defence Force Ombudsman.
The Commissioner will accept non-binding applications to establish an apprenticeship or traineeship from the Department of Defence under Section 7 of the Apprenticeship and Traineeship Act 2001 and register the applications in the register of apprenticeships and traineeships as such.
