Pursuant to Section 4 of the Apprenticeship and Traineeship Act 2001, the following guideline is issued in relation to the appointment of Industry Training Officers.
This guideline shall apply to the functions relating to the nomination and issuing of an appointment of an Industry Training Officer under Section 65 of the Apprenticeship and Traineeship Act 2001 (the Act) and the associated identification certificate.
Upon receipt of a nomination to appoint an Industry Training Officer, the receipting Officer in the Apprenticeships and Traineeships Unit must receive evidence of competence in the current units of prescribed training. This is a pre-requisite of an Industry Training Officers appointment. Upon receipt of evidence, and the approval of the Commissioner, the nominated Officer will be issued with an appointment and an associated identification certificate.
The scope of the Industry Training Officer’s role is outlined in the Act under Section 66, Section 67 and Section 68. The additional role of conciliator found in Section 40 of Act will be indicated by appointment and on the identification certificate when applicable.
An Industry Training Officers appointment is effective for 3 years whilst occupying a relevant position within the Department, unless earlier revoked.
All Industry Training Officers are required to surrender their identification certificate upon exiting employment and upon renewal certificates being issued.
Records of the appointment of Industry Training Officers and their application evidence are to be stored in a secure folder on the Departmental system.
This guideline shall be exercised by the Commissioner for Vocational Training and/or the Commissioner’s delegate(s).
