If you are going to court, you can ask Transport for NSW for a copy of your case file to help you prepare.

You should fill out this form two weeks before your hearing date to obtain a copy of your case details. A brief of evidence will be available once a hearing date is set by the court.

Is the matter related to court elect or have you been issued a court attendance number (CAN)?

This form is for people who have requested to have their penalty decided in court.

To have the matter determined by a court, you will need to complete and submit the court election form. Please visit Revenue NSW for details.

If you are unable to pay the penalty amount by the due date, you can set up a payment plan to pay over a longer period by contacting Revenue NSW or submitting a payment plan application. This form can be downloaded from Revenue NSW. Alternatively, please call Revenue NSW on 1300 138 118.

If you want to dispute or seek leniency for a penalty, you can seek leniency based on certain circumstances or if you believe an error has been made. To request a review, please visit Revenue NSW.

Roads and Maritime Services will store and protect your personal information until the enquiry or purpose of contact has concluded. Subject to any other legal requirements regarding information retention, your information will be retained for 30 days.

Background  

Personal information   

Personal information is any information or an opinion about an individual whose identity is apparent or can reasonably be ascertained.  

Health information 

Health information is a specific type of ‘personal information’ which may include information about your physical or mental health or disability. It includes information you provide to a health organisation, information about any health services you receive or have received in the past, and certain organ donation and genetic information.  

Privacy and Personal Information Protection Act 1998  

NSW Government Agencies must comply with the Information Protection Principles (IPPs), which are outlined in the Privacy and Personal Information Protection Act 1998 (PPIP Act). These regulate the collection, storage, use and disclosure of personal information held by Government Agencies.  

Health Records and Information Privacy Act 2002 

NSW Government Agencies, public and private health organisations and providers and large businesses that hold health information must comply with the Health Privacy Principles (HPPs), which are outlined in the Health Records and Information Privacy Act 2002 (HRIP Act). These regulate the collection, storage, use and disclosure of health information.
