NSW Trustee and Guardian is pleased to announce a collaboration with Down Syndrome NSW (DS NSW). The aim of the collaboration is to raise awareness amongst DS NSW members of the importance of Wills and Estate Planning.
NSW Trustee and Guardian in collaboration with Down Syndrome NSW (DSNSW) recently launched Estate Planning for parents of a child with a disability page on our website.
This gives parents and care givers important information on how to provide, plan for and organise care for a child with a disability when they no longer can.
Some of the information and considerations that have been developed to assist parents and guardians of those living with a disability to plan ahead include:
- what documents should be arranged ahead of time such as Wills, Power of Attorney and Enduring Guardian
- what considerations you should give when having your Will, Enduring Power of Attorney and Enduring guardian documents written
- considering the capacity of the child who is over the age of 18
- do they have capacity to make a Will?
- do they understand the nature and effect of a Will and have a general understanding of the assets and their value?
- be able to understand and consider the people in their life and the potential claim they might have on their estate.
- what to consider if your child is over the age of 18 but is dependent on you.
NSW Trustee and Guardian with consultation with their experienced Will makers have developed a brochure that provides information on estate planning for parents with children with a disability.
The brochure can be found here, an Easy Read has also been produced for parents to discuss this difficult topic with their adult children with intellectual disability.
