The terms and conditions, along with the privacy notice, for the Living with the River photo competition.
Terms and Conditions
By submitting an entry into the Living with the River Photo Competition (‘Competition’) held by the NSW Reconstruction Authority (‘RA’), each entrant (‘you’) and where you are under the age of 18, your parent/guardian, acknowledge and agree to the following Terms and Conditions:
1. Entry
- The Competition is free to enter.
- The Competition has five categories:
- primary school students (years K-6 in 2024);
- secondary school students (years 7-12 in 2024);
- open (18-years-old and over);
- semi-professional; and
- artificial intelligence (‘AI’).
- Where you are under the age of 18:
- you must have the consent of your parent/guardian to enter; and
- your parent/guardian must read the completed entry form, and read and agree to these terms and conditions, for your entry to be valid.
- Entrants will be deemed semi-professional photographers if they:
- have a business website/Facebook page which they use to publish their images to share with followers and/or the public or have previously received payment for images; or
- publish images for the purpose of income/profit.
- You can submit a maximum of 5 entries per person, each uploaded individually. If more than 5 photographs are received by the RA, only the first 5 will be eligible for consideration.
- If your photograph is created or developed, in whole or in part, using generative artificial intelligence tools or include any synthetic or artificially generated images or elements (including generative fill in post-production, your entry must be in the AI category and credit the AI tool and prompt to create the image.
- Your photograph must:
- include the Hawkesbury-Nepean River and address the theme ‘Living with the River’;
- not contain anything that could be considered animal cruelty or animal in distress; and
- not contain any form of infringing, threating, false, abusive, harassing, libellous, defamatory, pornographic or profane content.
- The Competition opens from 9am AEST on Monday, 26 August 2024. You must submit your online entry to the RA by 5pm AEST on Sunday, 26 January 2025. Late or lost entries will not be considered.
- Your entry must:
- meet and be submitted in accordance with the specifications outlined on the entry form (‘Specifications’); and
- include a completed online entry form.
- You must accept complete responsibility for gaining permission to enter and publish photos of any identifiable people featuring in your photographic entry. The Competition accepts no liability for entrants that have not been given permission to enter and publish photos of people featuring in the entered photograph.
- You may be disqualified from the Competition if you fail to comply with the Terms and Conditions.
2. Judging entries
- The judging panel (‘Panel’) selected by the RA will judge each valid entry and will select a first-place winner and a highly commended winner in the primary school, secondary school, open and semi-professional categories. Only one winner in the AI category will be selected. The decision of the Panel is final, and no correspondence will be entered into.
- Winners will be notified by phone and email by a representative of the RA.
3. People’s Choice Award
- There will be three People’s Choice Awards also selected from entrants across all categories.
- The People’s Choice award will be available for voting on the RA’s Facebook page after the closing date, 26 January 2025. The entrants from the eligible categories who receives the most votes wins the People’s Choice Award, and no correspondence will be entered into.
- Only votes conducted by way of Facebook ‘likes’ will be considered an eligible vote. Any Facebook comments will not be considered an eligible vote. Fraudulently obtained likes through paid services will result in removal from the competition.
4. Remuneration and prize
- Gift cards will be given as a prize for first place and highly commended in each category to the value listed below and for the People’s Choice Award. The gift card will be sent to the winner’s nominated email address.
- Primary school
- First-place winner - $100 Gift Card; and
- Highly Commended winner - $50 Gift Card.
- Secondary school
- First-place winner - $200 Gift Card; and
- Highly Commended winner - $100 Gift Card.
- Open
- First-place winner - $300 Gift Card; and
- Highly Commended winner - $150 Gift Card.
- Semi-professional
- First-place winner - $500 Gift Card; and
- Highly Commended winner - $250 Gift Card.
- Artificial Intelligence (AI)
- Winner - $200 Gift Card
- People’s Choice Award
- First-place winner - $500 Gift Card;
- Runner up - $250 Gift Card; and
- Second runner up - $100 Gift Card.
- Primary school
- A half-day photography workshop, delivered by a professional photographer and valued at $2,200, will be offered to the school attended by the student who wins the Secondary School category. The workshop must be arranged in consultation with the professional photographer and delivered within 12 months of the announcement of winners and cannot be exchanged for cash or any other prize.
- All prizes are not transferrable and not redeemable in cash.
5. Copyright and moral rights
- You, and where you are under the age of 18, your parent/guardian, grant the RA, and all sponsors and partners of the Competition, an irrevocable worldwide licence to reproduce, publish, and communicate to the public your photograph (or any part of it):
- in any media format, including but not limited to advertisements, postcards, brochures, posters, television/print media, websites, social media, apps, publications and reports;
- for the purposes of:
- the Competition, including any associated event or exhibition;
- publicity and promotion of the Competition;
- publicity and promotion of the RA including RA media and marketing campaigns;
- any publicly facing RA documents; and
- any archive of the RA or the Competition.
- You acknowledge and agree that the RA may adapt your photograph, including but not limited to adapting the photograph for the online gallery, for any large format reproduction for exhibition, or for use in RA media and marketing campaigns.
- You, and where you are under the age of 18, your parent/guardian, warrant that you are the owner of all intellectual property rights in the photograph, or have obtained all necessary approvals and consents to permit the entry of the photograph into the Competition and for use of the photograph in accordance with these terms and conditions.
- Semi-professional entrants may use their social media platforms to promote their entries but will NOT be exempt from clause 5.
- Photography that infringes the intellectual property rights of any person will be immediately removed from the Competition, and you must return to the RA any remuneration or prize money paid to you by the RA.
- The RA will use its best endeavours to acknowledge you in all Competition publicity as the creator of the photograph and credit images with the name of the artist in publication.
6. Release and indemnity
- You, and where you are under the age of 18, your parent/guardian, release the RA, from any claim, damage, expense, loss, cost or liability with respect to:
- the infringement of your moral rights in connection with your photograph; and
- the use of your photograph by the RA.
- You, and where you are under the age of 18, your parent/guardian, agree to indemnify the RA, against any claim, damage, expense, loss, cost (including reasonable legal costs) or liability (including liabilities of the RA to third parties) arising out of or in connection with:
- infringement of any intellectual property rights in respect of your photograph;
- use of your photograph by the RA, or the sponsors and partners of the Competition; and
- the Competition.
7. Exhibitions and events
- The RA may exhibit selected photographs in exhibitions and events across the Hawkesbury-Nepean Valley at various venues and sites from May to November in 2025.
- The RA will publish the winners’ photographs on the RA’s website at the end of February 2025.
- If the RA wishes to host an additional exhibition of Competition entries, or event related to the Competition, you agree to your photograph being exhibited with no fee or further remuneration being paid to you.
- Your exhibited photograph will be acknowledged on signage that lists your name and the title of the photograph.
8. Framed and/or large format reproduced photograph
- Any framed and/or large format reproduction of the photograph produced by the RA, including reproductions for the purposes of exhibition, will be the property of the RA.
9. Cancellation of the Competition
- If for any reason this Competition is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the RA which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, RA reserves the right in its sole discretion to cancel, terminate, modify or suspend the Competition, subject to any applicable legislation.
10. General
- The Competition is a game of skill, and chance plays no part in determining the winners.
- Employees of the RA, and their immediate families, are ineligible to enter the Competition.
- By entering the Competition, you, and where you are under the age of 18, your parent/guardian, acknowledge and accept these terms and conditions.
- The RA may cancel or vary the Competition or these terms and conditions at any time. The RA will not be responsible for any loss or costs incurred by you, or your parent/guardian if you are under the age of 18, in relation to such cancellation or variation.
Privacy Notice
What is Personal Information and why is it being collected?
Personal Information is information that identifies an individual. The NSW Reconstruction Authority (‘RA’) is collecting personal information for the purpose of running the competition and for general recordkeeping purposes. Examples of Personal Information that the RA may collect includes:
- Personal contact details such as names, addresses, email addresses, and phone numbers;
- Your age or date of birth;
- Your educational institution;
- Your signatures;
- Photographs depicting people; and
- Any other personal information you provide to the RA within a photograph submitted to the competition.
If you don’t complete the entry form, you cannot enter the competition.
How is my Personal Information being collected?
Personal information may be collected during the photo competition through the entry form or through a photograph you submit to the competition.
How is my Personal information going to be used?
- To contact you if you are the winner of the competition
- To send you a prize if you are a winner
- The RA will announce and publish the names of the winners of the competition and may also use your name to promote the competition
- If your photograph contains personal information (a photo of person, a house address etc.) the photo may be used by the RA or any sponsors of the competition for promotional and other purposes in the future (see T&Cs for details)
- For record keeping and archiving purposes
- For other purposes related to the competition
- Credit the submitted photograph including name, year and title for online, reproduction and exhibition purposes
What are my rights?
You may contact the RA at any time after the conclusion of the competition, including any exhibition, to withdraw permission for us to circulate or hold your personal information. The RA will respect your right to protect your privacy and will not circulate or hold your personal information unless required to by law.
The RA will not provide your personal information to a third party for any purpose not already stated in this privacy notice or terms and conditions without your consent.
The RA will take reasonable security measures to protect your personal information from loss, unauthorised access, use, modification, disclosure, or other misuse.
You may ask for access to the information we hold about you at any time and request to update, correct or amend your personal information by contacting the RA at hnv_dap@reconstruction.nsw.gov.au
