What is a Second Tier housing appeal
Find out how a Second Tier Appeal to the Housing Appeals Committee works and why it is different from a complaint.
A Second Tier Appeal is a request for a merits review of a decision made by a social housing provider to decline a client for a housing product. It is different from a complaint which is about dissatisfaction with the standard or type of service.
The Housing Appeals Committee (HAC) can only review appealable issues and a First Tier Appeal must be finalised before the matter can come to HAC.
What happens after you file an appeal
Once your file is received from the housing provider, a hearing date is set for your appeal. In considering an appeal, the Committee will review:
- your housing provider's policy
- information on your file and any new documents that you may have submitted with your appeal form.
How the appeal hearing works
The appeal hearing will have a presiding chairperson and one or 2 members. They will speak to you to better understand your situation and the reasons for your appeal. This informal process takes between 15 to 60 minutes.
Appeal hearings are usually done over the phone, but you can request an in-person or video hearing. An interpreter will be provided if you require one.
