The NSW Department of Communities and Justice seeks your feedback on the proposed Children and Young Persons (Care and Protection) Regulation 2022.

What’s this about?

The Children and Young Persons (Care and Protection) Act 1998 provides for the care and protection of children and young people in NSW, as is necessary for their safety, welfare and wellbeing. This Act, together with the Children and Young Persons (Care and Protection) Regulation 2012 (the existing Regulation), underpins statutory child protection services and provides the legislative framework for the child protection and out-of-home care systems.

The existing Regulation will end on 1 September 2022. The Children and Young Persons (Care and Protection) Regulation 2022 (the proposed Regulation) is intended to replace the existing Regulation with some proposed changes.

The changes to the existing Regulation are outlined in the following attached documents:

  • the proposed Regulation,
  • the Regulatory Impact Statement, and
  • the comparison table of changes between the proposed Regulation and existing Regulation.

Feedback from interested organisations and individuals is welcome on all aspects of the proposed Regulation, including matters not specifically raised in the Regulatory Impact Statement.
